About DAF and these terms
Stichting Dutch Aid Foundation (“DAF”) is a Dutch foundation registered with the Chamber of Commerce under number 96823658, with its registered office at Dommeldaal 22, 5282 WC Boxtel.
These terms apply to use of dutch-aid.nl and donations made through this website, WhyDonate, or the published DAF bank account. By using the website or donating, you agree to comply with these terms. Do not use the website or donate if you do not agree to the applicable terms.
An online donation is also subject to the terms shown by WhyDonate and the relevant payment provider before completion. If terms conflict, those external terms govern their own payment service and these terms govern the relationship with DAF, to the extent permitted by law.
Using the website
You may use this website for lawful, personal, and informational purposes. You must not:
- use the website for fraud, deception, harassment, discrimination, or another unlawful purpose;
- interfere with, test, or circumvent the operation, security, or availability of the website or connected services;
- send malicious code, unsolicited messages, or automated traffic;
- collect information in a way that infringes privacy or intellectual-property rights; or
- impersonate DAF, a staff member, partner, donor, or another person.
DAF may restrict access or take appropriate measures where reasonably necessary for security, compliance with law, or protection of DAF and others.
Information and availability
DAF tries to keep the website careful and current, but information may be incomplete, outdated, or temporarily unavailable. Project plans, humanitarian needs, external links, and provider information can change.
The website provides general information and is not legal, tax, financial, or medical advice. Obtain advice from a qualified professional for a decision requiring it.
DAF may maintain, change, interrupt, or discontinue the website. We do not guarantee uninterrupted or error-free availability.
Intellectual property
Unless stated otherwise, text, design, trade names, logos, and other content on this website belong to DAF or are used with permission. You may view the site and keep a limited copy for personal, non-commercial use.
You must not republish, alter, sell, exploit, or use content, photographs, logos, or marks without DAF’s prior written permission, or in a way that suggests DAF’s partnership or endorsement. Statutory exceptions, such as quotation rights, continue to apply. Third-party rights remain with their respective owners.
External services and links
This website links to third-party services and websites, including WhyDonate and WhatsApp. DAF does not control their systems, content, availability, security, or terms. A link does not amount to a general endorsement of everything on that external site.
Check the current terms, privacy information, donation amount, any fees, and payment details on the external platform before proceeding.
Donations
You can donate using the published DAF bank account or the active WhyDonate fundraiser. The following principles apply:
- A donation is a voluntary gift without a right to goods, services, influence, or a personal benefit of comparable value.
- DAF uses a gift for the purpose stated for the relevant fundraiser and within the foundation’s statutory humanitarian objectives. Unless DAF accepts a specific restriction in writing beforehand, the board decides how funds are responsibly applied within that purpose.
- If the stated purpose cannot be carried out, or cannot be fully carried out, DAF may—to the extent permitted by law—apply the gift to the most closely related humanitarian purpose. Where reasonably possible, DAF will contact an identifiable donor about a material change.
- WhyDonate and payment providers may deduct charges or handle payment methods, confirmations, and receipts under the information and terms they show at the time of donation.
- The donor is responsible for accurate contact and payment details, the selected amount, payment reference, and sufficient authority to use the payment method.
- DAF does not promise that a gift is tax-deductible and does not claim ANBI or CBF status. Obtain independent tax advice if needed.
If you are under 18, donate only with the permission and guidance of a parent or legal guardian.

Errors, cancellation, and refunds
Check the amount, purpose, and payment details before confirming. For an error, duplicate payment, unauthorised payment, or suspected fraud, contact DAF as soon as possible and, for an online payment, contact WhyDonate or your payment provider.
A correctly completed donation is generally final. WhyDonate’s current terms state that an online donation is normally non-refundable, except in cases including fraud or misuse verified by WhyDonate. DAF considers a direct request case by case and under applicable law but cannot guarantee a refund. Incurred costs that cannot be recovered may be deducted from any amount that can lawfully be returned.
This clause does not limit mandatory legal rights or prevent a bank, card issuer, WhyDonate, or other payment provider from applying its own process for an unauthorised or mistaken transaction.
Privacy and complaints
DAF processes personal data under the privacy notice. WhyDonate, WhatsApp, banks, and payment providers also process data under their own privacy terms.
You can submit a question or complaint about DAF through our complaints procedure.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including DAF’s liability for intent or deliberate recklessness where such a limitation is not permitted.
To the extent permitted by applicable law, DAF is not liable for indirect or consequential loss, loss of profit or data, or loss arising from third-party information or services, an interruption outside DAF’s reasonable control, or use of the website contrary to these terms.
If DAF is nevertheless liable, that liability is limited to direct and foreseeable loss sufficiently connected with the event. Mandatory consumer protections and other statutory rights remain fully applicable.
Changes
DAF may change the website and these terms, for example when its activities, providers, or the law changes. The current version and date appear on this page. A completed donation remains subject to the version in effect when it was made unless the law requires otherwise.
Governing law and contact
Dutch law governs these terms and the relationship with DAF. Disputes are submitted to a competent court in the Netherlands unless mandatory law gives you the right to rely on another court or law.
The Dutch and English texts are intended to have the same meaning. If their interpretation differs, the Dutch text prevails to the extent permitted by mandatory law.
